If these data contain identifiers (e.g., your name, company name, project reference linked to you), they constitute personal data under Art. 4(1) GDPR and are processed solely to provide the Service under Art. 6(1)(b) GDPR.
Purely technical data without identifiers (e.g., cable length calculations, wattage values) are not personal data. They remain your property and are governed by § 327p (2)–(3) BGB.
4. Purposes and Legal Bases for Processing

For the Free Online Heating Calculator used without registration: since no account is created and no personal data is retained beyond your session (except anonymized analytics with your consent), ceasing to use the Service effectively ends the processing of your session data. To withdraw consent for analytics cookies, please use the Cookie Banner on our website.
5. Recipients of Personal Data
Your data may be shared with:

All personal data is stored within the European Economic Area (EEA).
For analytics via Google Analytics 4, data is transferred to Google Ireland Limited under EU Standard Contractual Clauses (SCCs).
7. Retention Periods

Terms and Conditions
Terms and Conditions – Free Online Heating Calculator (B2C)
1.1. These Terms of Service (“Agreement”) govern your use of the warm-on Online Heating Calculator (“Service”), a free web-based tool provided by warm-on GmbH (“Provider”) via https://warm-on.com/heating-calculator.
1.2. This Agreement applies only to consumers (Verbraucher) as defined in § 13 of the German Civil Code (BGB). If you are an entrepreneur, legal entity under public law, or special fund under public law, this Agreement does not apply to you; please refer to our B2B Terms of Service.
1.3. Acceptance of Terms: By accessing or using the Service for the first time, you expressly accept these terms. If you do not agree, you must not use the Service. No signature or account creation is required.
2. Service Description
2.1. The Provider offers a free web-based Heating Calculator (“Service”) under the name warm-on Online Heating Calculator. The Service allows users to perform preliminary thermal calculations for underfloor heating and heat tracing systems based on user-provided input parameters. This Service is accessible via a supported web browser at https://warm-on.com/heating-calculator without registration or login.
2.2. The Service is provided free of charge. No payment, subscription, or account creation is required to use the core functionality.
2.3. The Provider may update the Service, including adding, modifying, or removing features. Notice of material changes to the core functionality will be published on the Provider’s website (e.g., via a banner or dedicated landing page) at least 14 days prior to implementation. Continued use of the Service after such notice constitutes acceptance of the updated terms.
2.4. User Responsibility for Input Data: The calculation results depend entirely on the accuracy and completeness of the data entered by you. You are solely responsible for verifying that your input parameters (e.g., room dimensions, insulation values, desired temperature) are correct and suitable for your project. The Provider does not guarantee that the output of the Service is suitable for final design, procurement, or installation without independent verification by a qualified professional.
2.5. Engineering Output Disclaimer. The Service is provided as a technical support tool intended to assist users. The Provider does not perform engineering services, project verification, or technical approval of any design, specification, or calculation generated through the Service. All outputs generated by the Service constitute automated software results based on user-defined parameters and do not replace independent professional review. The User remains solely responsible for verifying the suitability, safety, and compliance of any engineering result prior to procurement, installation, or operation. Nothing in this clause excludes liability for defects of the Service itself or for intentional misconduct or gross negligence.
2.6. Legal Nature of the Service. The Service is provided as free, time-limited access to cloud-based software functionality. This Agreement constitutes a contract for the provision of software as a service and does not create a contract for work, engineering services, or delivery of a specific project result. Statutory provisions applicable to the temporary provision of software functionality may apply to the extent required by mandatory law.
3. Right of Withdrawal (Widerrufsrecht)
3.1. Statutory Right: As a consumer, you generally have the right to withdraw from this Agreement within 14 days without giving any reason, in accordance with § 355 BGB.
3.2. Exercise of Right: To exercise your right of withdrawal, you may inform the Provider (info@warm-on.com) by an unequivocal statement. However, since the Service is free and requires no account, you must simply cease using the Service to effect withdrawal. Please note that if you have created an account, saved projects, or received reports via email, cessation of use alone does not constitute a request for data deletion; for that, you must contact us separately under Clause 8.3.
3.3. Consequence of Withdrawal:
No Reimbursement: Since the Service is provided free of charge, no payment was made. Therefore, no reimbursement, refunds, or compensation is applicable upon withdrawal.
Return of Benefits: In accordance with § 355 (3) BGB, received benefits must be refunded. For a web-based calculator, this means you must cease using the Service and delete any locally stored data (e.g. downloaded reports).
3.4. Digital Service Specifics: Please note that for digital services provided without a tangible medium, statutory exceptions may apply if performance has begun with your consent. However, given the free nature of the Service, the primary effect of withdrawal is simply the termination of use.
4. No Fees and Future Changes
4.1. Current Status: Free Service. The Service is currently provided free of charge. No payment, subscription, credit card, or account creation is required to access or use the core functionality of the warm-on Online Heating Calculator.
4.2. Future Changes. The Provider reserves the right to introduce paid premium features or modify the pricing model in the future. Any such changes will be:
Clearly communicated via a banner or dedicated landing page on the Website at least 30 days prior to implementation;
Optional – you may continue to use the current free version of the Service without accepting paid features;
Subject to your explicit consent – no charges will be applied without your prior affirmative agreement.
4.3. No Obligation to Pay. You are under no obligation to provide payment information or accept paid features to continue using the free functionality of the Service.
5. Data Protection
5.1. Principles of Processing. Your personal data is processed in accordance with the principles of lawfulness, fairness, transparency, purpose limitation, data minimisation, accuracy, storage limitation, and integrity and confidentiality as outlined in Art. 5 GDPR. The warm-on Free Online Heating Calculator is designed to operate without registration, login, or creation of a user account. However, if you choose to create an account, save projects, or request calculation reports via email, the Provider will process and store the necessary personal and project data for the purposes of providing and improving the Service, in accordance with our Privacy Policy.
5.2. Applicable Policies. Detailed information on the categories of data, purposes of processing, legal bases, and your rights is provided in our Privacy Policy and Cookie Policy. For the Calculator specifically, processing is limited to what is necessary to provide the requested service (e.g., IP address for session security, input data for calculation).
5.3. Cookies and Terminal Equipment. We use cookies and access information on your terminal equipment only in accordance with § 25 TDDDG. Essential cookies (strictly necessary for the provision of the service) are used without consent. Analytics cookies are used only with your prior consent. You may manage your preferences at any time via the Cookie Banner on our Website.
Withdrawal of consent: You may withdraw your consent at any time (a) via the Cookie Banner settings, or (b) by contacting us at info@warm-on.com. Please note that withdrawing consent for non-essential cookies does not affect the functionality of the core Service.
5.4. Your Rights. You have the rights under Articles 15–21 GDPR (access, rectification, erasure, restriction, data portability, objection). To exercise these rights, please contact us at info@warm-on.com. We will provide information on action taken without undue delay and within one month of receipt (Art. 12(3) GDPR).
5.5. Identity Verification. Since the Service does not collect names or email addresses by default, we may request additional information necessary to confirm your identity when processing requests under Articles 15–21 GDPR, in accordance with Art. 12(6) GDPR. This ensures we do not disclose personal data to unauthorized persons.
5.6. Data Processing Agreement. This Agreement and the accompanying Privacy Policy govern the processing of personal data for consumers using the Service for personal, non-commercial purposes. If you are acting in a professional or business capacity and require additional documentation regarding data processing (e.g., a Data Processing Agreement), please contact us at info@warm-on.com to discuss our B2B Terms of Service.
6. Intellectual Property
6.1. Ownership. The Provider retains all rights, title, and interest in the Service, including all software, algorithms, design, content, documentation, and underlying technology. Nothing in this Agreement transfers any ownership rights to you.
6.2. Limited License. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. This license does not include the right to:
copy, modify, adapt, or create derivative works based on the Service;
use the Service for commercial purposes, resale, sublicensing, or integration into third-party products or services without the Provider's prior written consent;
remove, alter, or obscure any proprietary notices, labels, or marks from the Service.
6.3. Reverse Engineering. You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying structure of the Service, except to the extent that such acts are expressly permitted by mandatory provisions of applicable law. In particular, decompilation may be permissible under § 69e UrhG only if:
it is indispensable to obtain the information necessary to achieve interoperability of an independently created program with the Service;
the information is not readily accessible to you;
the acts are confined to the parts of the Service strictly necessary for interoperability; and
any information obtained is used solely for interoperability purposes and not disclosed to third parties except where necessary for such interoperability.
Any person relying on this exception shall bear the burden of proving that all statutory conditions are met.
7. Liability
7.1. The Provider’s liability is governed by mandatory provisions of German law. The Provider shall be liable for willful misconduct and gross negligence (§ 276 BGB), for breach of essential contractual obligations (Kardinalpflichten) limited to typical and foreseeable direct damages, and under mandatory statutes including ProdHaftG (§ 1, § 11) and GDPR (Art. 82).
7.2. Given the free nature of the Service, liability for minor negligence is excluded for non-essential obligations, provided such exclusion is permissible under § 307 BGB. The Provider does not guarantee uninterrupted availability but shall use commercially reasonable efforts to maintain service functionality consistent with industry standards.
7.3. The Provider shall not be liable for damages arising from inaccurate user input, use of results without professional verification (Clause 2.4), or indirect/consequential losses.
7.4. Burden of proof for defect, damage, and causation rests with the user (ProdHaftG § 1(4)); the Provider bears burden of proof for exemption from liability under GDPR Art. 82(3).
8. Termination
8.1. Your Right to Stop Using the Service. You may cease using the Service at any time, without notice and without giving any reason. Since no account is created and no payment is made, no formal termination procedure is required.
8.2. Provider's Right to Suspend or Discontinue. The Provider may temporarily suspend or permanently discontinue the Service, in whole or in part, for technical, security, or legal reasons. Where reasonably practicable, the Provider will provide advance notice via a banner or dedicated landing page on the Website.
8.3. Data after cessation of use. If you used the Service without registration, no personal account or cloud-stored content is created, and no formal deletion procedure is required. If you created an account, saved projects, or received calculation reports via email, and wish to have your personal data deleted, please contact us at support@warm-on.com. We will process your request in accordance with Art. 17 GDPR (right to erasure) and respond without undue delay, and in any event within one month of receipt, as required by Art. 12(3) GDPR.
Any data temporarily stored locally on your device (e.g., browser cache, downloaded PDF reports) remains under your control. For information on processing of access data (IP address, browser type), please refer to our Privacy Policy.
9. Governing Law & Jurisdiction
9.1. This Agreement is governed by German law.
9.2. The mandatory consumer protection provisions of your country of residence remain unaffected.
9.3. For disputes, you may bring proceedings in Pforzheim, Germany.
10. Amendments
10.1. The Provider may amend these Terms with 14 days’ notice.
10.2. If you continue to use the Service after the effective date of the amended Terms, you accept the changes. If you do not agree, you must discontinue use before the effective date.
10.3. You always have the right to terminate if you disagree with the changes.
11. Entire Agreement
This Agreement, including its annexes, constitutes the entire agreement between the parties regarding the Service and supersedes all prior agreements, proposals, representations, or communications, whether written or oral, relating to its subject matter. Public product descriptions, website content, or marketing materials shall not be deemed contractual guarantees or agreed characteristics unless expressly incorporated into this Agreement.
